I tested putting the reference to prov:abstractElement inside the documentElements choice and it appears to not cause any weird issues with validation.  running the validation on constraint testcase and test cases in example/eg-40 conclude the same as they did before the change.

Should I move prov:abstractElement to be inside the choice?
