Patents and standards are a bad mix. Take a look at what happened with the GIF image format, the MP3 audio format and the PDF document format. At some point patents will always bite either the end-users or people trying to implement the standards. The reason why W3C standards have been so successful so far is in my opinion becourse they are patent free.
