The arguments put forward in the Patent Policy Working Group's FAQ, and in the draft Patent Policy itself are simply fatuous: patents are the single biggest threat to the web extant today. To try to include them within any genuine "cross-party" and "open" standard is like proposing that if, in the event of water not being available for fire-fighting, petrol will do instead. It is such a stupid and nonsensical idea that it is far more reasonable to question the integrity of those proposing it than to waste time debating the subject; either the proposers are idiots or they are liars with hidden agendas, in either case "debate" is simply a distraction from the fight which must take place to stop this rancid proposal.
