The penalty may simply be that you are ineligible for public sector contracts. It may be that you can be successfully sued in a civil court. The guidelines, may not be mandatory, but simply given as one example of good practice, compliance with which would demonstrate that you complied with the actual law, which might just require that service be accessible.
