I would urge people to read 6.10 <http://www.w3.org/2011/tracking-protection/drafts/tracking-dnt.html#exceptions-by-sites> on how the API works. Because the UA is allowed (encouraged, even) to ask the user, the API itself doesn’t tell you whether the exception was granted. You call the confirm API to check. It may be that this section needs an update to cover when scripting is disabled, but that is a problem not specific to DNT at all, so I don’t think so, myself.
