Michael, In a conference call on Feb. 11, 2004, the Query Working Group responded to your issue by adding the following paragraph to Section 2.5 of the XQuery document: "If the Static Typing Feature is not in effect but an implementation can nevertheless determine during the analysis phase that an expression will necessarily raise a dynamic or type error, the implementation may report that error during the analysis phase." Please let us know whether you are satisfied with this resolution of your issue.
