I think you would like to replace "expression will necessarily raise a
dynamic or type error" with "expression will necessarily raise a type
error" since the dynamic errors are dealt with already and are not
dependent on the static typing feature. But otherwise I am satisfied.

In a conference call on Feb. 11, 2004, the Query Working Group responded
to your issue by adding the following paragraph to Section 2.5 of the
XQuery document: 

"If the Static Typing Feature
<file:///C:\buildxq\lang\shared.html#dt-static-typing-feature>  is not
in effect but an implementation can nevertheless determine during the
analysis phase that an expression will necessarily raise a dynamic or
type error, the implementation may report that error during the analysis
phase." 

Please let us know whether you are satisfied with this resolution of
your issue.

Please add a sentence of the form "If an implementation can determine
during analysis phase that an expression is always raising a dynamic or
type error (if static typing option is not used), that error can be
reported during the analysis phase".
