Problems runnig validator on win32

I've got some problems runnig check,v 1.57 on win32.

The script dies when opening nsgmls (line 347) with "Bad file descriptor".

The file that could not be opened is my commando processor 'cmd.exe'. Perl
tries to open it in the actual directory (i.e.
E:\winapp\apache\validator\httpd\cgi-bin\cmd.exe) and gets a 'file not found',
cause cmd.exe is located at E:\winnt\system32\cmd.exe.

When i copy cmd.exe to the cgi-bin everything works fine.

Since e.g. check 1.45 works fine, there must be something in this version of
the check script that is responsible for this behaviour, but i could not
determine what!?

This error occurs when using 'Perl 5.005_63 built for MSWin32-x86' and
ActivePerl build 522.
