To be more specific: The HTML spec requires the title element to have
non-empty content (text content -- it's not allowed to have element content
in HTML; so any of its contents are parsed as text)

So a validator doing HTML parsing would flag that example as an error. (It
doesn't yet because we have a backlog of validator fixes in need of
landing, but I reckon I'll get that check added relatively soon.)
