Summary of 6 January 2003 Patent Policy Working Group Teleconference

Hello,

Twenty-five people attended the 6 January 2003 Patent Policy Working
Group (PPWG) teleconference. The Chair introduced two new participants.
The group discussed a summary of twenty of the comments [1] received on
the 14 November 2002 Working Draft [2] and established a procedure for
comment disposition. There was time to address six issues:

-  (L3) A PPWG participant will send proposed text to the group for
    discussion for a response to comments on the field of use restriction
    (GPL-related). The group seems to agree that the PPWG has reached a
    good compromise in the Last Call draft.

-  (L5) Making RF binding on all Members is a closed issue but may be
    used to talk about the exclusion deadline.

-  (L6) An edit will clarify that a PAG is not allowed to approve
    non-RF terms.

-  (L7) The group has discussed the limitation on sublicensing and is
    comfortable that exhaustion is not a problem.

-  (L8) Because licenses differ no additional "customary terms" would be
    specifically listed.

-  (L9) Old language in section 2.1 about the life of the patent may be
    removed. A PPWG participant will discuss on the group mailing list
    ways of protecting to some degree the reliance interest of parties
    that have implemented a W3C Recommendation before its recision.
