Technically PICS info must exist in the "headers" of the HTTP request/reply... So the answer is no, if the META tag does not exist in the <HEAD> where the DTD says it MUST be, an HTTP server or a WWW browser may refuse to honor it (and I wish they would; refer to reports at http://199.120.83.179/~moreese/msiebugs for more info)
