As a rule we avoid making non-control elements focusable, however, my feeling is that there are a few situations where it aids UX and understanding to have static elements in the tab order. The aforementioned panel being one. Focus order SC is wide enough to adequately cover when it is logical/illogical to do this so my feeling is that a blanket prohibition is unnecessary.
