In answer to this part of the question, it comes down to the interpretation of "If a form contains more than one submit button, only the activated submit button is successful." http://www.w3.org/TR/html4/interact/forms.html#successful-controls and whether a BUTTON with type "submit" also counts as a submit button (which, well, looks like it should really).
