This depends on whether the author is "relying upon" the newer technology in order to conform to the Guidelines.

If the author isn't relying upon the newer technology, i.e., the content conforms without it, then the new "failures" documented in non-normative material won't be applicable, since they're not relevant to conformance.

If the newer technology is relied upon, then the author can use it inappropriately - and this may make a difference to conformance, hence the new "feailure" cases become relevant.

Thus I think it all depends on the list of technologies relied upon, not on dates or other factors.
