Im not sure I follow what the issue is here. What I was assuming was that (at least as far the semantics is concerned) having the pair <n, emptyRDFgraph > in a dataset is exactly like not having any pair with the n label at all, so that {G, n1: G1} and {G, n1: G1, n2:emptyRDFGraph } are equivalent. The semantic point being that the empty RDF graph is semantically trivally true in all interpretations, so is always entailed by anything. Does that interfere with the CREATE rule above?
