I am not sure what you mean by 'acceptable'. If the EARL report clearly states that a specific test is not passed, then it can go into the report and we are fine. The goal is that each feature, ie, each test, should be passed by at least two (or was it three? we should check what we said at the CR transition) implementations. There may be tests that Toby passes and some others do not not...

I may misunderstand what you asked, though
