I see your point but I am not fully convinced that the spec allows the success or failure of static optimizations/checking to alter the semantics of the expression. It seems K2-SeqDocFunc-4 is one of the fn:doc tests you are remembering: http://dev.w3.org/cvsweb/~checkout~/2006/xquery-test-suite/TestSuiteStagingArea/Queries/XQuery/Functions/SeqFunc/NodeSeqFunc/SeqDocFunc/K2-SeqDocFunc-4.xq It allows both FODC0002 and XPST0001. So, at the very least, there is a long standing precedent for allowing this. I will update the tests I mentioned to include both results as you and O'Neil suggest.
