No, the ambiguity in the current wording applies to XPath as well as to XQuery.
I was left with an action to propose how the XPath text should be fixed;
comment #16 was merely recording a decision that this solution should have the
property that the XPath 1.0 and 2.0 expression ( / < 12 ) should continue to be
legal, even though it will no longer be legal in XQuery.
