If the static typing feature isn't in effect, an implementation isn't required to throw this error. Incidentally, many static typing implementations appear to ignore, apply selectively (e.g. only in path expressions) or allow this error to be switched off. If the static typing feature is switched off, the extent to which the static typing rules are used during query analysis is not prescribed by the standard. I'm specifically concerned here with running the tests with static typing feature switched off.
