Actually the static type inference rules (except for the official parent axis
rules I think) were designed that if you know that an element or attribute is
untyped, you will stay untyped. All you have to do to implement your switch is
to make sure that the root document node is typed as containing untyped
elements and you are fine. 

That's how we implemented the static typing of the non-schema constrained XML
data type (and skip sections) in our product and it works fine.
