The interview with Jeff Jaffe is worth to read. As far as I understand him he is (or was) not completely aware what the implications of DRM are and what the discussion here on the list is about (or the questions were incomplete). The discussion certainly is not just about potential patent issues. I personally think that they are secondary. Even the patent encumbered H.264 is specified in detail and the specification is available for everybody including Open Source developers and it can be implemented and used in many jurisdictions (which are not under the complete influence of certain lobby groups).
