As the spec is at a very early stage in the W3C process, pretty much everything in it is an open issue to some extent. The editors are always open to significant new evidence, which quite a few HTMLWG Participants are producing. The spec will be undergoing several rounds of review as it goes through W3C Process. The Status section makes clear HTML5 is currently an Editors' Draft.
