URL with & - Question

I received a URL from a web service vendor that contains an & in it.

According to the FAQ at the W3C
(http://www.htmlhelp.com/tools/validator/problems.html#amp) this is
invalid. The W3C software will not validate a page with an & in it.

Question: Should the author of a page be allowed to display the Valid
HTML logo from the W3C if this is the only reason for not validating?
