QNames and the XPointer namespace scheme

I have found another case of namespaces being declared outside the xmlns
framework, which would go against the Qnames policy currently being flagpoled.

It is in a draft WD that has not been released yet, so I won't discuss details,

Or are Qnames in an XPath not Qnames as currently being discussed?
