I favor issuing the erratum and allowing this. It costs little and is consistent with the rest of how XML behaves. Regarding the argument against allowing an 'illegal' i.e. non RFC 3066 value for this attribute, my preference is for XML 1.0.x to contain its own definitions to a reasonable extent, but even when external tables of values are referenced, to maintain control of questions of 'well formedness' and 'validity'.
