In the August 14th draft of the XML 2.0 spec. (at http://www.w3.org/TR/2000/WD-xml-2e-20000814), the last sentence of Appendix F says: the ... encoding-declaration PI [is] used... That sounds like it's referring to the XML Declaration (XMLDecl non-terminal) as if it were a Processing Instruction, which it is not. (By the way, section 4.3.3 says It is recommended that character encodings registered (as charset s) ... That is, the word "be" is missing, and "charsets" has a space in it.)
