<data> tag under <menu>?

Hi,

 

According to schema (http://www.w3.org/TR/voicexml21/vxml.xsd), <data>
is not a child of <menu>. Whereas according to dtd
(http://www.w3.org/TR/voicexml21/vxml.dtd), <data> is a child of <menu>.
Can anybody explain what should be the correct behavior?
