False unclosed element logging

I am getting a false report on two separate portions of the page. I am not looking to be perfectly valid but I try to make sure that I am not going completely rouge either. So here is some background information:

The falsely accused:

I went back and checked a few times and they are both closed properly. Just hoping to help progress the Validator. It's a great tool.
