Wrong explanation of the validator if title tag is missing

Dear Team,

In case of a page with the code as below, the validator wrongly explain
and does not point the corect problem with the code.

< !DOCTYPE HTML PUBLIC "-//W3C//DTD HTML 4.01 Transitional//EN" >

< html >
< head >

< meta http-equiv="Content-Type" content="text/html; charset=windows-1250" >
< /head >

The code above is not validated only because there is missing  < title >
.... < /title > tag
