Improper use of "Valid HTML" icons

Sorry if asking this at the wrong place, but I couldn't find any better
place.

What if a "Valid HTML" icon is used on a web page although the page's source
code actually is *not* valid. It's of course improper use of the icon, but I
haven't seen any rules or licenses for the use of those icons. If there are,
please give me a link.

BTW, I'm not on the list, so please CC me.
