I agree with Matthew on this matter. Just as CSS doesn't check if the jpg used for a background is copyrighted or not, it would not need to check if the font is licensed. It should be at the web-authors discretion to use legal material. However, if a DRM needs to be done, this would still be out of CSS's scope.
