Mark, John, WG, My concern was also that having & as the default encourages people to have lots of URIs containing & and they can also type those URIs somewhere in markup in addition to having them constructed at submission. But this default enabling authors to have no & at all in the document coupled with & support on the server indeed may be a better remedy.
