XForms WD 20011207 - itemset 'nodeset' attrib

The latest XForms draft seems to do a pretty good job of keeping presentation separate from element constraints. However, in section 8.11.3, the itemset element can now have a 'nodeset' attribute that dynamically assigns list values...  Is this not more relevant to the binding specification of an element? i.e. as far as I can see, the nodeset attribute 'constrains' the values of that element, all be it dynamically.
