FWIW, the EME spec was closely reviewed by the APA earlier this summer, and previously by the HTML5 Accessibility Task Force, and between strong MUST language around what part of the video stream can and can't be encrypted (currently only the H.264 encoded video*) and not the additional accessibility materials (caption, video description, transcripts), along with the fact that EME has no impact on the player or the controls (just the encrypted stream), I'm hard-pressed to see any accessibility concerns with this API.
<opinion>That said, there are opponents to this API and Premium Content Encryption seeking to halt this work at the W3C, and who demonstrate no apparent shame in trying to leverage mainstream fear and lack of awareness about the needs of PwD, and just play the "accessibilty" card, not in support of PwD, but rather to advance thier own agenda.</opinion>
Jon, what concerns can you suggest that we may have previously missed? Happy to try and answer any follow-on questions.
