I thought we had agreed to fix this in the schema for the XML namespace, not in the xs:language type definition, but the only record I can find of this is here, from Robin Berjon to the XML Schema IG [1] (member only), which simply offers a personal opinion (which I agree with): "Much agreed, xs:language should mirror RFC3066 and xml:lang should provide a choice between that and the empty string."
