Agreed, but there's nothing wrong with stating that this version of 
XHTML must not be served as text/html and that an XML MIME type must be 
used instead, without specifying exactly which one.  The current wording 
provides application/xhtml+xml and application/xml as examples only, 
which I think is acceptable.
