I would like to point out that their patent is not subject to a descriptive mark attack because it has already been certified. Their mark, however, expressly limits its product or service to "biometric" identification. Position a mark application towards that service by expressly limiting it to non-biometric identification, as I doubt that wc3 ever intends to incorporate fingerprints/retina scans,body fluid samples into its protocol.
