Interesting. I agree with @annevk's points. Port blocking needs to apply, or it would be a straightforward bypass. It's tricky because it happens at a different abstraction layer.

Maybe private network access is not a problem because it would need cooperation between the private network server and the public network server to do the migration? It would still be a weird loophole, even if it turns out to be benign.

I can't think of any other concerns right now.
