Good catch, we should remove that bit from HTML. Since it currently doesn't mutate the DOM or fire any events, I think we should stick with that, but I can write tests asserting that it is so as part of https://github.com/w3c/web-platform-tests/pull/6302.

Can you elaborate on how the (lack of) hierarchy restrictions pose a problem here?
