If that case, we would need to apply hierarchy restriction you mentioned to the whole top layer. Otherwise we would again meet issues like what I described in [bug 27865](https://www.w3.org/Bugs/Public/show_bug.cgi?id=27865#c0). Actually I feel this way is probably safer, as the elements in the top layer are strictly controlled in the same order in all places.
