That's not a normative conformance criteria, it's a statement of fact. It 
is indeed true, because, as Bjoern pointed out, the element is invalid and 
thus ignored. But that doesn't mean it's not invalid -- that statement is 
in fact empty (from a spec point of view) and could be removed without 
changing either the meaning of the specification or the conformance of any 
implementation or document.
