Pretty sure it's one of your tests since I couldn't understand it ;-) Anyway, you're right that changing the declared encoding would make that part of the test valid for the HTML test. For the XML test, it just causes parsing failure. I guess this just isn't testable unless you could force the implementation to serialize the document as a non-UTF-8 encoding..?
