If the content is not free or publicly available, then the data associated with the content accessibility for software use would not need to be free and publicly available either. If the content is free and available to the public, then the data should be available freely and publicly. I'd like to suggst a slight editorial tweak for readability: change "user agent supported manner" to "manner supported by user agents" in the text of the definition. Change the Note to read "Supported by user agents means ..." These do not affect the substance of either the definition or the note. But "user agent supported" is hard to read and understand.
