"non-normative" is IMHO something that fits better with parts of a specification. 

My first tentative response is that specifications should be used before they become a standard, and not the reverse. 
And having a specification stamped by an international body is not the only way to get something adopted ("zip" and the LCP DRM are two examples among 1000). 

The EU Directive does not make any technical specification normative: it simply says: 

The exception or limitation provided for in paragraph 1 shall apply on condition that the use of works and other subject matter referred to in that paragraph has not been expressly reserved by their rightholders in an appropriate manner, such as machine-readable means in the case of content made publicly available online.

What we have achieved is a simple & standardized way for publishers to express their will. Our technical specification is an appropriate solution to the problem of defining a "machine-readable solution" rightsholders can use, and this use is therefore backed up by a EU Directive = by laws.

Now, I agree that getting a W3C stamp would give more exposition to the specification, once it has proved that is fits its purpose. This is something we should do when sufficient feedback has been received from TDM Actors and from rightholders.
