We do have test cases (test set xs-error - some 49 tests). Some of them might be incorrect, and there might be tests that could be usefully added, but tests exist and in some cases there has been a lot of discussion. You seem to be trying to push for a complete change in the way xs:error support was introduced in XQuery 3.0.
