I agree. The spec says "The value to be bound to the variable is given in the
select attribute, which should be a simple XPath expression - typically a
literal, or a simple call on a constructor function." These were carried
forward from XQuery 1.0 tests, and it's hard to see what they were trying to
achieve, unless it was the ability to use the output of one query as input to
another.
