My observations were primarily focused on the title of this Issue which asks "Why would notice and consent not be adequate?" Yes, I was also reacting to the binary nature of your legal opinion on ePD and the GDPR, @jdelhommeau, not because it is my opinion you're wrong, but because I think it has the potential to be counterproductive. There's a strawperson being created here that seems to indicate that the prevailing opinion is that privacy/data protective systems, technologies, and standards don't fall under the law. I do not think that is the prevailing opinion. I realize @lknik asked the question, but that question is not representative of what I believe to be the likely conclusions many legal professionals are arriving at at the moment.

Bigger picture, I want us to avoid over-indexing to any one law or legal concept. There are several reasons for that. But the main one is I think what PATCG is trying to do and what other standards initiatives are trying to do can co-exist and, importantly, not break laws.
