Maybe this should be a configurable option? How about just not fail? It seems wrong to call it an error or a test failure. We get a valid HTML 4.01 document, and we can run plenty of tests on it, just not validate its markup. I say just give it the benefit of the doubt. Most docs like this will likely fail the XHTML Basic validation anyway.
