after a "cvs up" and rebuild the element is available, but always false.
Is there more todo?

But, isn't it easier to check this via XSLT with the XPath:
not(exists(/moki/primaryDoc/XHTMLDocInfo/docContent/html:html))
and skip generating the xmlNamespace element?
