I'd be interested to discuss later today an extension of the SC text "Target Size" that would accommodate situations like stacked lists of links (think 'Table of Contents') where the target height is often below 26px while having an obverall spacing of 26px might be achievable. This is a (very rough) draft of the modification as amended by Alastair that I pasted in in Tuesday's telco: "The size of the target for pointer inputs, including non-interactive space surrounding the target not shared with other targets, measures at least 26 by 26 CSS pixels except when:" (exceptions follow) It may well be that this doesn't work, but it could address some likely objections that will be raised towards requiring a target size of 26x26px.
